No Legal Advice Disclaimer

The information provided through TopLawyersNow.com, including all content, attorney profiles, legal resources, articles, FAQs, responses to questions, and directories, is for general informational purposes only. The content available on this site may not reflect recent legal developments, court rulings, or changes in the law. It is not intended to be, nor should it be construed as, legal advice.

Using this Service does not create an attorney-client relationship between you and any lawyer listed on the site or with TopLawyersNow.com itself. Legal issues are highly specific to individual circumstances, and no user should act or refrain from acting based solely on the information available on this site. If you need legal advice, you should consult a licensed attorney in your state or jurisdiction who can assess your unique situation and provide guidance based on the applicable laws.

We make no guarantees about the accuracy, completeness, or reliability of the legal information presented. TopLawyersNow.com disclaims all liability for actions taken or not taken based on the content provided through this platform. Indemnification

By using TopLawyersNow.com, you agree to fully indemnify, defend, and hold harmless TopLawyersNow.com, its owners, officers, directors, employees, affiliates, licensors, agents, service providers, and partners from and against any and all claims, demands, liabilities, damages, losses, costs, or expenses, including reasonable attorneys’ fees, arising from or related to:

  • Any content you submit, post, upload, transmit, or make available through the Service.
  • Your use or misuse of the Service, including but not limited to reliance on information found on the site.
  • Your violation of these Terms of Service, including any improper, unauthorized, or illegal use of the platform.
  • Your infringement upon the rights of any third party, including but not limited to intellectual property rights, privacy rights, publicity rights, or any other legal rights.
  • Any disputes, conflicts, or issues arising between you and any attorney, user, or third party as a result of your use of the Service.

This indemnification obligation applies regardless of whether the claim arises from negligence, breach of contract, tort, strict liability, gross negligence, malpractice, statutory violations, or any other legal theory. Class Action Waiver

By using TopLawyersNow.com, you agree that any dispute, claim, or controversy arising from or relating to your use of the Service shall be resolved exclusively through individual legal action. You expressly waive any right to participate in or be represented in any class action, collective action, or other representative proceeding against TopLawyersNow.com, whether in arbitration or litigation.

Even if applicable law permits class actions, you acknowledge and agree that any legal action you pursue against TopLawyersNow.com must be brought solely in your individual capacity and not as a plaintiff, class member, or representative in any class or group proceeding. You further agree that any arbitrator or court handling a dispute shall have no authority to conduct class-wide proceedings or consolidate claims from multiple parties.

This class action waiver is material and essential to the agreement between you and TopLawyersNow.com, and it is non-severable from the arbitration clause. If for any reason a court determines that this class action waiver is unenforceable with respect to a particular claim, then that claim alone shall proceed in court, while all other claims remain subject to arbitration.

In the event of a violation or challenge to this class action waiver, TopLawyersNow.com reserves the right to seek immediate judicial enforcement of this provision. You acknowledge that this waiver is fundamental to the dispute resolution process and that any attempt to circumvent it would cause irreparable harm to TopLawyersNow.com.

Limitation of Liability and Waiver of Claims Related to Data Breaches

By using this website and its associated services, including but not limited to directory listings, attorney profile management, or legal search tools, all users—including both attorneys and clients—expressly acknowledge and agree that TopLawyersNow.com, its owners, affiliates, employees, and contractors shall have no liability whatsoever for any actual or alleged loss, damage, unauthorized access, disclosure, breach of data security, or misuse of data, whether caused by our own negligence, gross negligence, recklessness, willful misconduct, carelessness, breach of contract, error, omission, technical failure, hacking, cyberattack, or violation of any federal, state, or local law, statute, or regulation.

To the fullest extent permitted by applicable law, all users and listing attorneys hereby irrevocably waive any and all claims, causes of action, demands, or damages, known or unknown, arising out of or related to any alleged data breach or security incident, including any statutory claims, common law claims, or claims for negligence, gross negligence, or breach of fiduciary duty.

In no event shall our total liability to any user or attorney—whether free or paid—exceed the total amount paid to us by such user or attorney, if any, during the twelve (12) months preceding the event giving rise to the claim. Users and attorneys further waive any right to seek or recover attorneys’ fees, expert fees, litigation costs, or statutory damages, even where such recovery may be authorized by statute, court rule, or otherwise.

This limitation and waiver apply to all claims, including but not limited to claims brought under consumer protection laws, privacy laws, breach notification statutes, data security laws, or any other state or federal law that may purport to impose liability for data handling practices. This section is a material term of this agreement, and your continued use of the site signifies your agreement to these terms.

Jurisdiction, Venue, Arbitration, and Governing Law

Mandatory Arbitration for Claims

Any dispute, claim, or controversy in which the amount in controversy exceeds $8,000, shall be exclusively resolved through binding arbitration in Miami-Dade County, Florida under the Federal Arbitration Act (9 U.S.C. §§ 1 et seq.). Arbitration shall be administered by National Arbitration and Mediation (NAM) under its Comprehensive Dispute Resolution Rules and Procedures. Each party is responsible for their own legal costs and arbitration fees.

Neither party shall have the right to a jury trial, and pre-arbitration discovery will be limited to what is provided under the arbitration rules. The arbitrator’s decision shall be final and binding, and judgment on the award may be entered in any court with jurisdiction. If this arbitration provision is found to be unenforceable, then disputes shall be subject to the exclusive jurisdiction and venue provisions outlined above.

Any dispute, claim, or legal proceeding arising out of or related to TopLawyersNow.com, including any services provided through the platform, found not subject to arbitration shall be exclusively litigated in the United States District Court for the Southern District of Florida in Miami. If the federal court lacks subject matter jurisdiction, the dispute shall be resolved before a state court in Miami-Dade County, Florida. By using this Service, you expressly consent to the jurisdiction and venue of these courts and waive any objections related to jurisdiction or forum selection.

Small Claims Court for Low-Value Disputes

If a dispute involves damages less than $8,000 (excluding attorney fees, costs, and interest), the claim must be brought exclusively in small claims court in Miami-Dade County, Florida. Any attempt to file such claims in another jurisdiction is expressly waived.

Choice of Law and Forum

These Terms of Service and the relationship between you and TopLawyersNow.com shall be governed by the laws of the State of Florida, without regard to its conflict of law provisions. You agree that any disputes arising from or related to these Terms of Service, your use of the Service, or any associated matters shall be subject to the exclusive jurisdiction of the courts located in Broward County, Florida.

Governing Law and Forum Selection

This Agreement, and any disputes arising under it, shall be governed by and construed in accordance with the laws in the State of Florida, which preempts and supersedes any conflicting state or federal laws, except as otherwise provided by said laws with regard to non-waiver of rights. By using the Service, you expressly consent to the personal and exclusive jurisdiction of these courts and waive any objections to venue or jurisdiction in those courts.

By using TopLawyersNow.com, you acknowledge and agree to these provisions, including the requirement to resolve disputes in Florida and waive any right to participate in class actions or jury trials.
